Investment Funds

Based on the European Central Bank Regulation (EC) No 1073/2013 (dated 18 October 2013) concerning statistics on the assets and liabilities of investment funds (ECB/2013/38), investment funds are obliged to provide the Dutch Central Bank (DNB) with information and data.

An investment fund is a company for collective investment:

  • investing in financial and non-financial assets, insofar as it pursues investment of capital attracted from the public (i.e. retail/private, professional and institutional investors) for one or more participants;
  • issuing rights of participations;
  • established pursuant to Community law or national law in accordance with:
    I)   contract law (as common funds managed by investment management companies);
    II)  company law (as an investment company);
    III) another, similar mechanism.

For a further explanation of the notion of investment fund you are referred to the Financial Supervision Act [Wet op het financiële toezicht (Wft)], with the provision that the applicable exemption criteria of this Act with respect to the minimum participation amount and the number of participants do not apply for this report. As a consequence, the investment funds exempted under the Wft have to comply with the DNB reporting obligation for investment funds.
