Question:

How can an investment firm request permission to apply the CRR instead of the IFR?

Answer:

We may grant permission to investment firms to apply the requirements of the CRR instead of the requirements of the IFR if they meet the conditions set out in Article 1(5) of the IFR. Investment firms wishing to use this option can submit an application to us. They must include the following information:

  1. A calculation of the actual and required liquidity and solvency at consolidated level based on the CRR/CRD.

  2. Calculations of the capital requirements at individual level based on the CRR and based on the IFR, in which the CRR requirements must not be lower than the IFR requirements.

Based on the information submitted we will assess whether the application for permission meets all conditions of Article 1(5) of the IFR. If that is the case, we will grant permission to apply the CRR requirements instead of the IFR requirements We will formally decide on applications for permission after the IFR/IFD have entered into force in the Netherlands.
