DNO for MiCAR (Articles 41 and 83 MiCAR)

Factsheet

Under certain circumstances you or your company will need prior consent from DNB to acquire a qualifying holding in a financial enterprise. In specific cases, you must also apply for a DNO if you wish to expand a shareholding in a financial enterprise.

Published: 29 July 2024

If you plan to acquire or expand a qualifying holding in an asset referenced token (ART) issuer or a crypto-asset service provider (CASP) (target companies), you may need a declaration of no-objection (DNO). The issuers of ARTs and CASPs are companies that will require autohorization under Markets in Crypto-Assets Regulation (MiCAR) as of June 30 2024 and December 30 2024, respectively. Therefore, the DNO applications for CASPs can currently only be submitted and processed in draft form.
